Last week, the U.S. Supreme Court ruled 8-1 to limit lawsuits against medical device makers if the Food and Drug Administration approved a device.
Today, the court hears oral arguments in a case that revolves around whether a state court can take up a lawsuit over whether a drug company misled the agency in order to get a drug approved.
Consumer groups are howling about last weekâ??s decision and fear the court will side with business on this one, too.
