Judge blocks ordinance aimed at I-69 work noise

The Indiana Department of Transportation can resume nighttime work on the Interstate 69 extension near Bloomington.

Marion County Judge David Dreyer issued a temporary injunction Monday blocking a Monroe County ordinance that limited noise on the project between 10 p.m. and 6 a.m.

Dreyer found the law appears to be on INDOT's side in the dispute, The Indianapolis Star reported. He also cited worker safety and potentially higher construction costs.

An INDOT lawsuit contends Monroe County had no authority to limit construction. INDOT contractors faced the threat of $7,500 fines for every violation.

INDOT spokesman Will Wingfield says the agency "remains committed to working with Monroe County and its residents to minimize noise" on the project.

An after-hours message seeking comment was left for the Monroe County attorney.

    I would think given the history of totaliarism in Italy you would be embarassed to even take the name Italiano--did you come hear legally--maybe we should check?????

    Italiano, I have yet to see a positive comment posted by you. Perhaps you would be better suited to live in a state you find more to your liking? Perhaps a state other than Indiana? While we would be sad to see you go, we would be willing to make the sacrifice so you could lead a happier life. We are supposed to enjoy the journey and your frequent commentary sounds like you are not enjoying living here.
  • Money to burn
    Monroe County must have money to burn to pass an ordinance that obviously was bound to fail from a legal standpoint. The obstructionists should step aside and let level headed, thinking folk iron this out. Once the Tree Huggers and Socialists drive on the new freeway a time or two, they will find something else to try to hinder.

    You make it sound like the Governor just snapped his fingers to make this project a reality. Only 30 years in the making! Maybe he needs a more authoritative finger snap!
  • Make Noise
    I say all those who are affected by this noise go to this judge's house at all hours of the morning and play make some noise! Bring the marching band :)

    I guess comparing our own government to Nazis is neither obscene, abusive, or hateful. I would consider it so. Oh well.

    When Herr Governor Dence (Or ditch Mitch) says there WILL be a highway, then THERE WILL b a highway, and the people be dammed as they goose step toward completion. Give it a couple of hears and it will be as full of potholes as the rest of our roads
