In court documents filed Monday, the group called the tragedy “a true accident or Act of God” and said the victims “knowingly and voluntarily assumed and/or incurred the risk of injury to themselves." Sugarland, a defendant in a class-action lawsuit seeking damages in the collapse, blamed others for not evacuating the grandstands despite deteriorating weather. But Indiana State Fair Commission chief Cindy Hoye has testified that the band twice refused to delay the concert.
