Marion County Judge David Dreyer issued a temporary injunction Monday blocking a Monroe County ordinance that limited noise on the project between 10 p.m. and 6 a.m.
Dreyer found the law appears to be on INDOT's side in the dispute, The Indianapolis Star reported. He also cited worker safety and potentially higher construction costs.
An INDOT lawsuit contends Monroe County had no authority to limit construction. INDOT contractors faced the threat of $7,500 fines for every violation.
INDOT spokesman Will Wingfield says the agency "remains committed to working with Monroe County and its residents to minimize noise" on the project.
An after-hours message seeking comment was left for the Monroe County attorney.
