Council Democrats dismiss lawsuit against former president Clay

Eight members of the Indianapolis City-County Council and the council clerk have decided to dismiss their lawsuit against former council President Stephen Clay.

The lawyer for the plaintiffs said the lawsuit was no longer necessary because new council leader Vop Osili restored the employment of fired council clerk NaTrina DeBow and council attorney Fred Biesecker after he was installed as president Monday night.

“The purpose of our case was to get them back into their jobs and that’s what they got,” said attorney Karen Celestino-Horseman.

In the lawsuit filed Feb. 8, the plaintiffs said Clay, a Democrat, broke Indiana law and Marion County ordinances governing council personnel with the firing, and by denying other counselors to ability to receive advice from Biesecker.

Celestino-Horseman said she was circulating a document to the lawyers involved in the case regarding the dismissal. The judge will have to sign and approve it.

Clay’s lawyer, Linda Pence, did not immediately reply to IBJ’s request for comment.

Biesecker told IBJ he was “very grateful to President Osili for giving me the opportunity” to serve again.

DeBow was not immediately available for comment.
