Two defendants blamed for errors in the Central Library expansion project have agreed to pay the Indianapolis-Marion County Public Library $1.27 million.

Patriot Engineering and Environmental Inc. and The Rosk Group Inc., both locally based, agreed to a settlement May 15 after participating in a series of court-ordered mediations, the library announced this morning.

Both firms were involved in construction of the underground parking garage. Library officials halted construction on the project in March 2004 after discovering gaping holes and other defects in the concrete.

The expanded Central Library reopened in December, more than two years late and roughly $50 million over its original $103 million budget.

The latest settlement is part of the library’s legal quest to recoup cost overruns from design and construction firms. So far, it has collected more than $20 million.

The settlement with Patriot and ROSK does not resolve all pending claims relating to the library’s litigation. The library said it will “continue to vigorously pursue recovery in the litigation of damages incurred as a result of the acts and omissions of the remaining defendants.”

In February. the library settled with nine other parties – including locally based Shook LLC, the garage contractor – for $17.65 million.

The library still is pursuing claims against New York-based Thornton-Tomasetti Engineers and inspection firm Charlier Clark & Linard PC of Indianapolis. In late March, a Boone County judge ruled in favor of the firms on claims of negligence.

Any new claims the library brings may only be for fraud against Thornton-Tomasetti and breach of contract against Charlier.
