Would anyone notice if this place went out of business?
Well, that would prove it did not impact residents negatively.
I recall some reporting early on about neighbors complaining to the town about the amplified music (which led to the noise ordinance updates), but those references are strangely absent from this story, which simply repeats the allegations in the lawsuit.
It would be interesting to know the history of the why the town created the new noise ordinances. If they were in direct response to neighbor’s complaints from this particular nuisance property, then I could say say that it might look like the town was picking on this business, but the reality might be the neighbors petitioned local government to redress this nuisance.
And if the laws got updated several times, it could be the town and neighbors were just dealing with a slick local business that could afford to spend more money on lawyers than the average homeowner and that business kept finding loopholes while continuing to be a nuisance.
I have had a local catering/banquet business get out of control in our downtown neighborhood. was is frustrating when you can’t invite guests over because they can’t find parking or to have puking “patrons” on your front lawn. And then come to find out the business can afford to spend a lot more money on lawyers than adjacent homeowners all the while they continue to be a nuisance at the neighbors expense.
The ordinance, I believe, states that concerts or noise must be over by 10 pm. I also believe that the neighborhood is directly south of the Geist reservoir, which means the council may be under pressure from the comfortably rich. There is also the town attempt to directly compete with Daniel’s and may be attempting to keep councils’ thumb on the scale to the benefit of town coffers.
