  1. At some point, common sense needs to come into this equation. If you are going to get beat up in a sport, you wear protective gear. It’s a bit like using common sense to wear a motorcycle or bicycle helmet when riding. You don’t need a law or the government to cause you to come in from the rain.

    1. Common sense?!? Nah, the plaintiffs bar would never think that should come into play….

    2. Wearing a helmet while on a bicycle wasn’t “common sense” until about 25 years ago. Before that, nobody even thought twice about it. It took lots of data collection by the government, and lobbying by scientist and medical people, to realize there was even a problem. “Common Sense” isn’t as common as you think.
