    1. Well, the legacy of jobs excluded from minimum wage and hence more likely to have tip based income started with the fist minimum wage laws on the mid 1900’s. Then overtly racist southern Democrats strongly objected to allowing service people to receive a minimum wage because “if those people were paid a decent wage, they would have no incentive to provide goof service”. In this case “those” people were mainly Blacks, because in the Sothern economy, service jobs went almost exclusively to Blacks.

      Since then , in the US, the Republican party has selectively embraced the “no regulations” idea to allow employers to pay sub-level wages in broad categories of service jobs inflating and normalizing a culture of tipping. On top of billions in tax cuts for the ultra wealthy throwing a bone to the service class is inconsequential in the big picture.

    2. Because it was a campaign-trail stream-of-conscious impulse that played well to audience’s emotions, that Congressmen lost the political spine to subsequently bury due to the basic lack of logic you mention.
