Biomet told the Joournall Gazette of Fort Wayne that the settlement could cost more than $50 million. The Warsaw-based company said it is pleased to have the multi-state case resolved.
The settlement will resolve complaints related to its M2A Magnum hip replacement, the company said.
There are more than 950 Biomet hip lawsuits filed in the Northern District of Indiana that allege injury due to metal debris shed from the hip system, court papers said.
People who had the metal-on-metal hip implanted and replaced must sue Biomet in federal court by April 15 to participate in the settlement. But attorney Tom Anapol says others who file claims after the deadline could potentially file their own lawsuits or negotiate another group settlement.
The newspaper reports that this model of hip replacement has never been recalled.
