Judge dismisses suit against Indiana immigration law

Two parts of Indiana's immigration law will remain in effect after a federal judge dismissed a lawsuit by a northwestern Indiana Hispanic advocacy group challenging them, the Indiana attorney general's office said Wednesday.

U.S. District Judge Jon DeGuilio dismissed the lawsuit filed by East Chicago-based Union Benefica Mexicana for technical flaws Tuesday because it improperly named the state of Indiana, the governor, the attorney general and three northwestern Indiana county prosecutors as defendants. Those parties have sovereign immunity from lawsuits under the 11th Amendment, the attorney general's office said in a news release.

The lawsuit also named three northwestern Indiana county sheriffs as defendants, but DeGiulio said Union Benefica Mexicana had not shown that it had legal standing to sue them.

The lawsuit challenged a portion of a sweeping immigrant law passed by the General Assembly in 2011 that allow the state to sue employers to recoup unemployment benefits from employers who knowingly employ unauthorized or illegal workers.

It also challenged a section requiring workers seeking day-laborer jobs to complete individual attestation-of-employment forms and requiring police to submit a complaint to federal immigration authorities if they have probable cause to believe that a worker has not completed the form, the attorney general's office said.

A U.S. Supreme Court ruling against an Arizona immigration law last year left other parts of Indiana's law unenforceable but did not affect the sections that Union Benefica Mexicana was challenging.

Attempts to reach Union Benefica Mexicana for comment were unsuccessful because its published telephone number has been disconnected.

Even E-Verify that should have become mandatory after the pilot program had shown promise and that it had a 98 percent success rate. Tell me why, when other industrialized nations will prosecute illegal entry as a felony, when the United States call it a civil infraction? Again why when the fabricated laws by legislators have not sent to the Supreme Court, the BIRTHRIGHT CITIZENSHIP law that its interpretation is for slaves of the American Civil War to claim citizenship given to future generations and not "NOT" for pregnant women to gain citizenship with their babies and children Hundreds of Billions BILLIONS of dollars that taxpayers are required to pay for an assortment of benefits. These children get automatic citizenship and we get the bill; money that should be spent on our elderly folks, the homeless, and those in poverty. This law desperately needs to be amended, so the money doesn't go to supplement the mix families of illegal and legal persons. Cash payments, food stamps and the other benefits, that end up in the hands of illegal parents, because of this wrongly interpreted law. What the corrupted idiots in Washington are not telling you that the 11 million (if that was true) that this population will end up around another 30 million because of the archaic sponsorship law. Sponsors sign an affidavit of financial support, but that dribbles away and older family members can become destitute, and then they become another burden on the U.S. taxpayers. Once we had the sure way to bring in good immigrants and that was the "Points System" as they are using in Australia. According to your skills, family circle and other contingencies whether they receive a working visa. With the points system only countries that have a low immigrant quota, gets a visa. There is a sign along the side of the highway on the I-8 e on the border with Arizona. It adds up exactly what is happening across the country, given to us by unconcerned legislators. Its states that Arizona, doesn't welcome you, but Los Angeles does; offering free housing, free schools, free food, free medical and free hospitals; no insurance costs, no taxes and plenty of job and then it gives direction to head for California. No wonder America is financially hurting and just goes to show that the American people have few of the rights given to us in the Constitution, pushed aside by the Lib Democrats and the Republicans. We should convince those who are authoring the House Congressional bill, that not all revenue for 20.000 newly recruiting agents, but at least half should be appropriated for ICE (the interior U.S. Immigration and Custom Enforcement) to seek out illegal immigrants within the United states itself. They are the satellite agency that raids businesses and corporations who believe they are above the law. Those politicians who play into the illegal alien invasion, will be kicked out the on their reelection. And that's our promise. The TEA PARTY is expressing you sacrifice some time, as we we have all have got to get involved? Sen. Marco Rubio (R-FL) is claiming that if the House doesn't do something the "poison pen" president will grant amnesty to millions of illegals with an Executive Order—no controls. But here's the thing... Republicans are holding out over the border security issue...but the threat is much greater. Talk to the folks in Arizona and they'll tell you: Washington has it all wrong. As one Arizona Sheriff said: "...Rubio, you’re making decisions for me, for my state, for my county, my city when you haven’t even been here... You know nothing about our border. Yet you’re making those decisions without even speaking to us." Washington is blind. If they grant amnesty to illegals, they're opening the floodgates to drug cartels, thieves, molesters, thugs and the biggest inflow of criminals into the US has ever seen. Other illegals will take our jobs and suck at the entitlement trough. wage will drop and American citizens and legal residents, will be living on food stamps. We're planning to march into Washington over this in big numbers to sway votes. Can you spare a few bucks to help us carry out "Operation Kill Amnesty?" Currently, 1500 DEA agents on just 83 miles can't stop the drug cartels or human traffickers. House Republicans think their paper measures will? Not on your life. Before any more talks, we must demand internal enforcement. Drug traffickers are amassing weapons, technology and small armies that are threatening our national security. Yet, Washington's plan provides NO guarantees for the billions of dollars allocated for security. It's up to us to stop Washington. Ryan that the unemployment rate for Blacks in the United States is nearly double the national level and that amnesty would have a "disastrous effect" on all low-wage workers. A new analysis from the Center for Immigration Studies has determined that 57.5 million native-born Americans between the ages of 16 and 65 were not working during the second quarter of 2013. That figure is up 17 million from the second quarter of 2000. Proponents of the Schumer-Obama amnesty bill (S.744), however, claim that there are not enough workers currently living in the United States?
