City may borrow to pay Bisard litigants

The city of Indianapolis doesn’t have the money to pay $2.3 million in legal settlements to two people injured in the 2010 crash involving Indianapolis Metropolitan Police Officer David Bisard.

The Office of Finance and Management has initiated a proposal to issue as much as $2.5 million in bonds to pay the settlements due to Kurt Weekly and Mary Mills.

City Controller Jeff Spalding said he considers the bond issue the city’s only option, since the 2013 budget spends down most of the rainy-day fund. The current budget left $4 million in the fund, he said, noting that’s less than 1 percent of the city’s $600 million general fund. The proposal will go before the City-County Council’s Administration and Finance Committee before coming up for the council’s approval.

Under a settlement reached last fall, Weekly, who was critically injured, is owed $1.35 million, and Mills, who was seriously injured, is owed $975,000. Riding on the same motorcycle, Weekly and Mills were with two friends headed to lunch at the time of the crash. The three motorcycles were stopped at the intersection of East 56th Street and Brendon Way Parkway when Bisard’s patrol car barreled through. One of the other riders, Eric Wells, was killed.

Bisard has not yet faced trial on charges that include reckless homicide and criminal recklessness.
