Judge delays ruling on dismissal of White case

An Indiana judge expects to rule by Dec. 16 on whether Indiana Secretary of State Charlie White must stand trial on voter fraud and other criminal charges that could lead to his ouster.

Attorney Carl Brizzi urged Hamilton Superior Court Judge Steven Nation on Friday to dismiss the seven felony counts against White. The charges stem from accusations the Republican lied about his residence in the 2010 primary so he could continue collecting his salary from the Fishers Town Council.

Brizzi argued the grand jury that indicted White in March did not allow evidence favorable to White to be introduced.

White also faces a civil lawsuit filed by Democrats seeking to have him declared ineligible for office. A Marion County judge is expected to rule in that case this month.
