Mitch Daniels must give a deposition in lawsuits over his decision to cancel a nearly $1.4 billion contract with IBM to process welfare applications is going before the Indiana Supreme Court.
The court's justices are to hear oral arguments in the case Monday morning.
A Marion County judge ruled in December that a law state attorneys say protects Daniels from testifying is ambiguous and excluding Daniels from questioning would be "illogical," given that the state filed the first lawsuit in the case.
Indiana is suing IBM to recover more than $400 million it paid the company before Daniels canceled the 10-year contract in 2009 amid complaints about the automated welfare system. IBM's countersuit says the state still owes it about $100 million.
