    1. I agree, but half of Indiana population (by voting for Republicans) would disagree whether they know it not.

      Small, underfunded, business friendly government what Republicans want and listening to the rhetoric, anything else is considered socialism.

    I’m sorry, but be serious. No judge is going to acknowledge that as a legitimate contract. Disney spends billions on lawyers and that’s the best argument they have?

  2. Might be a good time for Congress to step in and abolish the “blue pencil rule”–which generally says that if one provision is unenforceable, then the rest of the agreement can still be enforceable. This type of judicial interpretation gives lawyers the green light to be unreasonable when drafting these adhesion contracts (contracts where one side has absolutely no ability to negotiate the individual terms). Congress should instead offer legislation that every term in an adhesion contract must be fair and reasonable, otherwise, none of it will be enforceable under the law.

    1. They don’t care about the amount, they don’t want to open themselves up to future liability. But, the arbitration agreement is fairly bold defense claim. The better argument is that they did not own or operate the restaurant, and then it will come down to the facts if they had any say in the marketing, or some control over it.
