Drugmakers versus consumers

Congress and the courts long have tried to balance regulations to try to protect consumers while giving companies space to operate.

Last week, the U.S. Supreme Court ruled 8-1 to limit lawsuits against medical device makers if the Food and Drug Administration approved a device.

Today, the court hears oral arguments in a case that revolves around whether a state court can take up a lawsuit over whether a drug company misled the agency in order to get a drug approved.

Consumer groups are howling about last weekâ??s decision and fear the court will side with business on this one, too.
