The House Transportation Committee voted 8-1 Wednesday to repeal a 2004 law that prohibits the highway from passing through southern Marion County's Perry Township.
Bill sponsor Rep. John Price of Greenwood said he wants state highway officials to have the option of using the Indiana 37 corridor for the I-69 leg between Martinsville and the I-465 loop around Indianapolis.
Committee Chairman Ed Soliday of Valparaiso said he believes the current law violates a state constitution prohibition on the Legislature deciding highway routes.
Even if the bill clears the House, senators who represent the township oppose the highway following Indiana 37.
