  1. I would be surprised that the NCAA was able to “trademark” these terms. Except for “March Madness” those terms were used by the IHSAA LONG before the NCAA started using them. As for March Madness, the State of Illinois, in their tournament used the term again before the NCAA was using it. Indeed, I think the NCAA needs to be sued for using those terms WAY after others had already used them. Go back to the records. I saw those terms in many high school records as far back as the 1920s before there was a “Real” NCAA.

    1. They could have purchased those rights from past owners. You can also apply for a trademark, even itf used prior. There is a waiting period for others to oppose and prove it was used previously. It is their right to protect those trademarks and surprised DraftKings would purposely use the trademark. Technically anyone using the term can be sued, ie restaurants, but they aren’t going to see them as a threat or taking any value away from the terms. NCAA should win this, quickly.

  2. I love how Draft Kings uses “fair use”. Generally “fair use” is a term that also doubles as “defendant”. I bet the NCAA wins this one
