  1. I’m not a lawyer but this just seems like common sense to me… if you have a jury trial and they find you not guilty of one thing you shouldn’t be punished for it, period.

  2. This appears to be an AP story that IBJ probably has not checked so as to verify “facts” in the story. That being said, notice the use of the two words, “muder” and “killing.” This leads me to think that while the jury did acquit the defendant of murder, there was evidence (perhaps even strong evidence) that the defendant did the “killing.” In any event, I am pretty sure that the transcript will show that the judge did not add on 13 years for “murder.”
