They sat on this for three months until it finally happened.
Trump has treated and found ways to make our legal system powerless. I fully expect him to ignore the law or find work arounds.
Lets see if the treasury and Customs follow the president or Supreme Court instructions
Today’s Supreme Court ruling is an overdue reminder that we are a nation of laws, not of unilateral executive edict.
For years, the tariff regime was justified under “emergency” authority in ways that stretched the statute beyond recognition. Whatever one thinks of tariffs as policy, using emergency powers to bypass Congress should concern anyone who values constitutional structure and market stability. The Court was right to say no.
From a business perspective, many of us have watched these tariffs function less as strategic leverage and more as a tax on American companies and consumers. If their removal eases supply chain costs and price pressures, that will be a welcome development for Indiana businesses.
The broader point is this: durable economic policy should come from Congress, not from improvisation under emergency statutes. Markets need predictability. The Constitution requires accountability. Both were reinforced today.

So will Treasury say they no longer have the money or will Trump just ignore the decision?
I suspect that the refund process most likely will require “aggrieved” companies to file a claim the federal government that quantifies their economic “injury.” I don’t see a way that individual consumers would be able to obtain a refund, though.
Individuals being unable to get a refund … will only be the first of many instances over the next year in which individuals are unable to obtain relief from the Trump Administration. Just wait for the midterms and the rampant voter suppression and rigging we shall see by Republicans.

It’s going to be more painful undoing the damage done by Trump than most think… and for this, we can all thank Mitch McConnell, the gravedigger of American democracy.
Glad someone finally stepped in to stop his ever continuing power grab because our representatives sure will not. Interesting this comes on the heels of a Fed report which outlines the ill affect of the tariffs on the economy, which of course this administration disputes since he is under the illusion that the costs are not passed on.
The administration “disputes” anyone or any study that disagrees with their economic, defense, and foreign policy fantasies.

This is the perfect opportunity for Congress to reassert its authority but I don’t think we should hold our breath for that.
3 of his lapdog justices who voted with the majority (including the concurrence) are going to have some explaining to do…they may well be spanked with a rolled up newspaper, or the contemporary equivalent, being smacked around by FOX and other MAGAt “journalists”.

Tariffs are NOT taxes. Let me repeat. TARIFFS are NOT TAXES. They are nation to nation trade agreements. No, a President (unlike maniacal mayors like Mamdani) cannot create and impose taxes on American CITIZENS. That is the Constitutional domain, rightly, for Congress. A watchmaker in 🇨🇭 Switzerland does not have to offer its products to the USA market. A US CITIZEN is required to pay TAXES. Brad R, income taxes are not the only taxes collected by state and feds.
When the companies that import and sell things pay tax (tariffs) to the government, they add it to the price and charge customers (we the people) more. We never get a W-2 for withholding and they don’t go on our 1040s but we pay those taxes nonetheless.
Another example is the sales tax. It’s collected at the cash register and it never shows up on any W-2 or 1040, but it is still a tax.
The executive should just ignore this.
Let SCOTUS “enforce” this unenforceable mess.
